SwapSquad™ Privacy Policy

This Privacy Policy describes how ESC (Education Sports Community), LLC ("Education Sports Community," "we," "our" or "us") collects, stores, uses, discloses, shares and protects user information collected via use of the SwapSquad™ Mobile Application ("App") and SwapSquad™ website located at www.swapsquad.io (the "Site"), and all related SwapSquad™ Offerings. Capitalized terms that are not specifically defined herein shall have the meanings set forth in the SwapSquad™ Mobile Application End-User License Agreement and Website Terms and Conditions ("Terms").

This Privacy Policy covers our treatment of personal information and other information that we collect when end-user visitors to the Site ( "User," "you" or "your"): (a) download, or attempt to download, the App as made available on the iPhone®, iPad® and other mobile devices that run the iOS operating system, as well as Android® and other mobile devices, where and to the extent available (collectively, "Mobile Device") by and through the Apple® App Store, the Google Play® store and other applicable venues (collectively, "Download Venues"); (b) access or use the Site; (c) access links to SwapSquad's™ social media pages/accounts on third party social media websites ("Social Media Websites"), such as Instagram®, Facebook® and LinkedIn® (collectively, "Social Media Pages"); (d) register on the Site/in the App, which provides Users with access to: (i) viewable "Content," including SwapSquad™ Leaderboards, SwapSquad™ Stats (as each of those terms is defined below) and other material made available through the App and on the Site; (ii) interactive areas of the Site/App, such as comment sections, that enable Users to interact with other Users ("Interactive Services"); and (iii) an array of season-long fantasy sports-based games involving players from professional baseball, basketball (men's and women's), football and/or hockey (collectively, "Contests); (e) utilize the various contact forms and/or contact information made available on the Site/in the App as a means to contact directly, or request to be contacted by, Education Sports Community (collectively, the "Contact Services," and together with the Site, App, Content, Social Media Pages, Interactive Services and Contests, the "SwapSquad™ Offerings"); and/or (f) otherwise affirmatively consent to this Privacy Policy.

Any information you provide through your use of the SwapSquad™ Offerings is subject to the terms of this Privacy Policy, as may be updated by Education Sports Community from time to time. Please read this Privacy Policy carefully before using and/or accessing the SwapSquad™ Offerings.

If you do not agree with the terms of this Privacy Policy, in this entirety, you are not permitted to access or otherwise use the SwapSquad™ Offerings.

Your California Privacy Rights

Education Sports Community will never share, sell, rent, exchange or barter your "personal information" (as defined in the Shine the Light Law, Cal. Civ. Code § 1798.83) to or with any third-party for financial gain or marketing purposes; provided, however, that we may, in certain limited instances, share your personal information with third parties who perform administrative functions on our behalf.

Your Nevada Privacy Rights

Education Sports Community will never share, sell, rent, exchange or barter your "personal information" (as defined in the Shine the Light Law, Cal. Civ. Code § 1798.83) to or with any third-party for financial gain or marketing purposes. However, if you are a resident of the State of Nevada and would like to opt-out from any future sale of your personal information to any third party data broker, please email us as at: info@swapsquad.io; or send us U.S. Mail to: ESC (Education Sports Community), LLC, 145 East 16th St., #14L, New York, NY 10003.

Information We Collect

User Information: When you register an account and/or otherwise access the SwapSquad™ Offerings, Education Sports Community may collect the following information:

  • Your name;
  • Your email address;
  • Your username;
  • Your phone number;
  • Your date of birth;
  • Your mailing address;
  • Your location (where you have provided consent to same);
  • Identity verification information (including, but not limited to, driver's license, passport, voting card or similar government issued identification) (collectively, "Sensitive Information"); and/or
  • Any other information you submit to Education Sports Community.

You agree that all information you provide in using the SwapSquad™ Offerings shall be accurate, complete, and up-to-date. It shall be your sole responsibility to update any and all information provided for use of the SwapSquad™ Offerings.

Additional Information Collected by Education Sports Community or Third Parties: When you access the SwapSquad™ Offerings, additional information may be automatically collected by Education Sports Community, as well as third parties acting on our behalf, such as Adjust GmbH ("Adjust"), AppsFlyer Ltd. ("AppsFlyer"), Branch Metrics, Inc. ("Branch"), Google, Inc. ("Google") and Meta Platforms, Inc. ("Meta"). This information is collected by the aforementioned third parties for Education Sports Community's internal tracking, analytics and/or other non-marketing-related, business purposes. Such information may include:

  • Your browser information;
  • Your operating system;
  • Your IP (Internet Protocol) address;
  • Your device and/or usage data;
  • Information regarding your use of the SwapSquad™ Offerings (e.g., pages viewed, the amount of time spent on particular pages, purchase history, transaction data, etc.); and/or
  • Information automatically collected through cookies, web beacons, or other technologies used to provide additional functionality to the SwapSquad™ Offerings.

Behavioral Tracking; Cookies: We do not use cookies or other tracking technologies to deliver marketing to our Users. We use cookies for Site analytics, to manage the consumer consent process and to improve the operation of the Site. Education Sports Community only uses cookies and other technologies to gather, store, and track certain information related to your use of the SwapSquad™ Offerings in order to manage the KYC process and to operate/improve the SwapSquad Offerings. A "cookie" is a piece of data stored on your device containing information about your access to the SwapSquad™ Offerings. Cookies may be sent by us or our third-party vendors. By using our SwapSquad™ Offerings and/or otherwise accessing the Website, you agree to Education Sports Community's use and storage of cookies on your device used to access the SwapSquad™ Offerings. If you do not wish for cookies to be stored on your device, you can deactivate the relevant option in the system settings of your browser. You can also delete stored cookies in the system settings of your browser at any time. Please be advised that if you elect to turn off cookies, some features of the SwapSquad™ Offerings may not work properly.

Adjust®

We may also use the "Adjust®" tracking tool, as made available by Adjust, on the Site and in the App. Adjust may collect some or all of the following information by and through the Adjust tracking technology: (a) computer/mobile device and advertising identifiers (including IDFA, IDFV, Google Advertising ID and Adjust device identifiers, where available); (b) computer/mobile device and technical information, including device type and model, operating system and version, App and SDK version, language, time zone, IP address, network and carrier information, and user agent; (c) App installation, session, attribution and referral information; and (d) information regarding interactions with the App, including App launches, pages or screens viewed, clicks, events, purchases and other in-App activities that we configure the Adjust tracking technology to measure (collectively, "Adjust Data"). Adjust shares Adjust Data with us.

We may combine Adjust Data with your personal information. Adjust is not permitted to use Adjust Data for marketing purposes. Information pertaining to Adjust's use of Adjust Data and Adjust's Privacy Policy can be found here.

AppsFlyer®

We may also use the "AppsFlyer®" tracking tool, as made available by AppsFlyer, on the Site and in the App. AppsFlyer may collect some or all of the following information by and through the AppsFlyer tracking technology: (a) computer/mobile device and technical information, including device type and model, operating system and version, browser information, system language, network and carrier information, IP address and user agent; (b) computer/mobile device, advertising and application identifiers, including IDFA, IDFV, Google Advertising ID, AppsFlyer ID and other similar identifiers, where available; (c) App installation, download, launch, attribution and referral information; and (d) information regarding interactions with the Site and App, including pages or screens viewed, clicks, engagement time, in-App events, purchases and other activities that we configure the AppsFlyer tracking technology to measure (collectively, "AppsFlyer Data"). AppsFlyer shares AppsFlyer Data with us.

We may combine AppsFlyer Data with your personal information. AppsFlyer is not permitted to use AppsFlyer Data for marketing purposes. Information pertaining to AppsFlyer's use of AppsFlyer Data and AppsFlyer's Privacy Policy can be found here.

Branch®

We may also use the "Branch®" tracking tool, as made available by Branch, on the Site and in the App. Adjust may collect some or all of the following information by and through the Branch tracking technology: (a) computer/mobile device and advertising identifiers, including IDFA, IDFV, Google Advertising ID, Android ID and other similar identifiers, where available; (b) Branch cookie identifiers; (c) IP address; (d) computer/mobile device and technical information, including operating system and version, CPU type, Internet connection type, carrier information and user agent; (e) referral and link information; and (f) information regarding interactions with the Site and App, including ad impressions and clicks, pages or screens viewed, downloads, installations, tracking opt-in status, purchases, engagement time and other events and activities that we configure the Branch tracking technology to measure (collectively, "Branch Data"). Branch shares Branch Data with us.

We may combine Branch Data with your personal information. Branch is not permitted to use Branch Data for marketing purposes. Information pertaining to Branch's use of Branch Data and Branch's Privacy Policy can be found here.

Google®

We may also use the "Google Analytics®" and "Firebase" branded tools, as made available by Google, on the Site and in connection with the App. Google may collect some or all of the following information by and through the Google tracking technology: (a) city and country of the User; (b) device type (desktop, mobile, tablet, etc.); (c) browser type; (d) referring website, search engine or social media platform; (e) Site/App pages visited; (f) time spent on each Site/App page; (g) navigation path through the Site/App; (h) actions taken on the Site/in the App (clicks, downloads, form submissions, registrations, etc.); and (i) exit pages (collectively, "Google Data"). Google shares Google Data with us.

We may combine Google Data with your personal information. Google is not permitted to use Google Data for marketing purposes. Google's ability to use and share the Google Data and other information collected about your visits to (and use of) the Site is restricted by the Google Analytics® Terms of Service, available here, and the Google Privacy Policy, available here. You may learn more about how Google collects and processes data specifically in connection with these tools here. You may prevent your data from being tracked and/or used by Google by downloading and installing the Google Opt-out Browser Add-on, available here.

Meta®/Facebook®

We may also use web analysis tools called Meta Ads Manager® and Meta Pixel®, as made available by Meta. Meta may collect some or all of the following information by and through the Meta Ads Manager® and Metal Pixel® tracking technologies: (a) traffic data from Facebook® Users who visit the Site/App; (b) demographic information of Facebook® Users who visit the Site/App; (c) actions taken on the Site/in the App (clicks, downloads, form submissions, registrations, etc.); (d) attribution for purposes of Facebook® ad conversion; and (e) click-through rates from the Site/App (collectively, "Meta Data"). Meta shares Meta Data with us.

We may combine Meta Data with your personal information. Meta is not permitted to use Meta Data for marketing purposes. Information pertaining to Meta's use of Meta Data and Facebook's® privacy policy can be found here.

General Do Not Track: In general, Users may be able to disable some, but not all, of this tracking activity by utilizing the "Do Not Track" setting or similar options within most major Internet browsers. In addition, Users may be able to opt-out of this form of tracking utilizing the options made available by the Network Advertising Initiative or Digital Advertising Alliance. To the greatest extent permissible under applicable law, we are not responsible for the tracking practices of third-parties in connection with the Site.

Cross Device Tracking: Education Sports Community tracks Users' use of the Education Sports Community Offerings across multiple devices, including personal computers and Mobile Devices.

Aggregated Personal Data: Education Sports Community may also aggregate, anonymize or de-identify information collected by the SwapSquad™ Offerings or via other means so that the information cannot, on its own, personally identify you. We may share this aggregated and/or de-identified data with our affiliates, agents and business partners. We may also disclose aggregated and/or de-identified User statistics and other metrics related to our SwapSquad™ Offerings in order to describe our products or services to current and prospective business partners and to other third parties for other lawful purposes.

Geolocation Tracking: Where you consent to same, Education Sports Community uses geolocation technology to track Users' locations for purposes of confirming eligibility to utilize the SwapSquad™ Offerings.

Use of Your Information

Education Sports Community may use the information we collect for one of the following reasons:

  • To verify your eligibility to use the SwapSquad™ Offerings and/or identify you as an account holder;
  • Administrative purposes;
  • To respond to customer service reports;
  • To alert Users to new products, content and/or features;
  • To prevent fraudulent or criminal activity;
  • To enforce our Terms, Contest Rules, and/or other policies governing your use of the SwapSquad™ Offerings;
  • To send promotional content or other communications concerning Education Sports Community products and/or services, or the products and/or services of third parties that we think may be of interest to you; and/or
  • To track User engagement relating to use of the SwapSquad™ Offerings.

We may also use information provided by you for reasons for which we have a legitimate business interest, such as direct marketing, individual or market research, complying with applicable state and/or federal law or regulations, or any other purpose disclosed to you at the time you provide information or with your consent. In all cases, the type of information collected and the purposes listed above are necessary for our legitimate business interests including, without limitation, to develop our products and services, grow our business, study how visitors use our SwapSquad™ Offerings, and inform our marketing strategy.

Sharing Your Information

Education Sports Community does not trade, sell, or otherwise share your personally-identifiable information with third-parties for marketing purposes or for any reason other than as set forth in this Privacy Policy. We use best commercial efforts to ensure that third parties with whom your personally-identifiable information is shared do not use your personally-identifiable information for any purpose other than those specified by us or otherwise required by law. Notwithstanding the foregoing, Education Sports Community may share your information for any of the following reasons:

Fulfilling SwapSquad™ Offerings: We may share your personal information for the purpose of conducting testing, locating Users, personalizing and improving your use and experience of the SwapSquad™ Offerings, sending emails and push notifications, providing customer support, and preventing harmful and/or unlawful uses of the SwapSquad™ Offerings.

Business Transfers: We may share your personal information if Education Sports Community is involved in a merger, acquisition, sale, bankruptcy, or other reorganization (e.g. insolvency, reorganization, or any other transaction changing either ownership or control of the company); provided, however, that if Education Sports Community is involved in a bankruptcy proceeding, merger, acquisition or sale of all or a portion of its assets, you will be notified via e-mail and/or a prominent notice on the Site and in the App of any change in ownership or uses of your personal information, as well as any choices that you may have regarding your personal information. You acknowledge and agree that Education Sports Community has no control over how such information is treated, transferred, or protected by such third parties.

Related Companies: We may share and disclose your personal information with any subsidiary, affiliated company, or member of our company group.

Agents, Consultants and Related Third Parties: We may share your information with our business partners, suppliers, and/or subcontractors as necessary in order for them to provide services relating to your use of the App and/or Site.

Legal Requirements: We may disclose your information: (a) to our accountants, attorneys, and/or other professional advisors who owe a duty of confidentiality to Education Sports Community; (b) as required by applicable KYC regulations and/or other third party obligations imposed upon Education Sports Community relating to your use of the SwapSquad™ Offerings; and/or (c) if required to do so by law or if we have a good faith belief that such action is necessary to: (i) comply with a legal obligation; (ii) protect and defend the rights or property of Education Sports Community; (iii) act in urgent circumstances to protect the personal safety of Users of the SwapSquad™ Offerings or the public; or (iv) protect against legal liability.

Accessing, Modifying or Deleting Your Information

You can access and update certain personal information that Education Sports Community has collected about you by logging into your account. You can also modify and/or update your information on the App and/or Site, or request changes by emailing us at info@swapsquad.io. You may request deletion of certain personal information maintained by us, and we will make all reasonable efforts to honor your request. Deletion requests may be made on the App and/or Site, or by emailing us at info@swapsquad.io. Please be advised that deleting your personal information may terminate your access to certain of the SwapSquad™ Offerings. If you wish to continue using the full complement of SwapSquad™ Offerings, you may not be able to delete all of the personal information that we have on file for you. Please be further advised that, after you delete your personal information, residual copies may take a period of time before they are deleted from our active servers and may remain in our backup systems. Please also note that we may be legally required to keep certain information for a certain period of time (in which case we will comply with your deletion request only after we have fulfilled such requirements).

Security

We endeavor to safeguard and protect our Users' personal information. When Users make personal information available to us, their personal information is protected both online and offline (to the extent that we maintain any personal information offline). Where our registration/application process prompts Users to enter Sensitive Information and when we store and transmit such Sensitive Information, that personal information is encrypted with advanced TLS (Transport Layer Security).

Access to your personal information is strictly limited, and we take reasonable measures to ensure that your personal information is not accessible to the public. All of our Users' personal information is restricted in our offices, as well as the offices of our third-party service providers. Only employees or third-party agents who need User personal information to perform a specific job are granted access to User personal information. Our employees are dedicated to ensuring the security and privacy of all User personal information. Employees not adhering to our policies are subject to disciplinary action. The servers that we store User personal information on are kept in a secure physical environment. We also have security measures in place to protect the loss, misuse and alteration of personal information under our control.

Please be advised, however, that while we take every reasonable precaution available to protect your data, no storage facility, technology, software, security protocols or data transmission over the Internet or via wireless networks can be guaranteed to be 100% secure. Computer hackers that circumvent our security measures may gain access to certain portions of your personal information, and technological bugs, errors and glitches may cause inadvertent disclosures of your personal information; provided, however, that any attempt to breach the security of the network, our servers, databases or other hardware or software may constitute a crime punishable by law. For the reasons mentioned above, we cannot warrant that your personal information will be absolutely secure. Any transmission of data at or through the Site, other SwapSquad™ Offerings or otherwise via the Internet or wireless networks, is done at your own risk.

In compliance with applicable federal and state laws, we shall notify you and any applicable regulatory agencies in the event that we learn of an information security breach with respect to your personal information. You will be notified via e-mail in the event of such a breach. Please be advised that notice may be delayed in order to address the needs of law enforcement, determine the scope of network damage, and to engage in remedial measures.

You agree that we may communicate with you electronically regarding security, privacy, and/or administrative issues regarding your use of the SwapSquad™ Offerings. If we learn of a security system's breach, we shall notify you electronically by posting a notice on the Site and in the App, or sending an email to the email associated with your account.

Retaining Your Information

Education Sports Community will retain your information while you are an active User of the SwapSquad™ Offerings, and for as long as needed thereafter in accordance with applicable law. Before we use any of your personal information for any new purpose not originally authorized by you or otherwise set forth in this Privacy Policy, we will use best efforts to provide details regarding the new purpose and give you the opportunity to opt-out.

Opt-Out

We may send you marketing communications or emails that contain information about our products and services, or information about upcoming features. You may opt out of receiving such notifications by making necessary changes as made available via your account. You can also unsubscribe from such communications by emailing us at info@swapsquad.io. Notwithstanding the foregoing, you will not be able to opt-out of certain administrative communications regarding the SwapSquad™ Offerings – e.g., communications regarding your participation in Contests, as well as updates to our Terms or this Privacy Policy. To opt-out of receiving SwapSquad™ Offerings-related messages from Education Sports Community, you must cease utilizing the SwapSquad™ Offerings.

Your Privacy Rights

The following rights may be exercised directly by you or, in certain cases, through an authorized agent:

  • You have the right to request information about the categories and sources of information we collect, our purposes for collecting the information, and how it is used. Details about our data collection, use and third-party disclosures can be found in this Privacy Policy. In addition, you have the right to request a copy of your personal information.
  • You have the right to request that we correct and/or delete some or all of the personal information that we have about you, subject to certain exceptions (i.e. information used to provide the SwapSquad™ Offerings, honor opt-outs, prevent fraud, spam and/or other abuse, comply with our legal obligations, cooperate with law enforcement, and/or exercise and defend our rights).
  • You have the right to opt out of the sale of your personal information, and to request information about whether we have sold your personal information in the past twelve (12) months. We do not sell personal information. Should such change, we will notify Users and provide an ability to opt-out as required.
  • You have the right to request that we limit use and disclosure of your personal information to uses necessary to provide the SwapSquad™ Offerings, comply with legal obligations, or as otherwise permitted by applicable law(s).

To exercise your rights, please contact customer support at info@swapsquad.io. In order to respond to your request(s), we must be able to verify your identity as the owner of the account and/or personal information you are inquiring about. We may verify identity by confirming that you are the owner of the email address associated with the account to which the personal information is associated. An authorized agent submitting a request on your behalf must also have access to the email address associated with the account, along with sufficient evidence (as determined in Education Sports Community's sole discretion) that you have authorized that person to submit the request on your behalf. Education Sports Community does not discriminate against anyone because they exercise any rights herein.

Children's Policy

The SwapSquad™ Offerings are not directed toward individuals under eighteen (18) years of age (or the age of majority in the jurisdiction from which you access the SwapSquad™ Offerings) and we do not knowingly collect information from individuals under eighteen (18) years of age (or the age of majority in the jurisdiction from which you access the SwapSquad™ Offerings). If you are under eighteen (18) years of age (or the age of majority in the jurisdiction from which you access the SwapSquad™ Offerings), please do not submit any information through the SwapSquad™ Offerings. If we become aware that we have collected personal information from individuals under eighteen (18) years of age (or the age of majority in the jurisdiction from which you access the SwapSquad™ Offerings), we will take reasonable steps to delete it as soon as practicable.

Third Party Websites

The SwapSquad™ Offerings may contain links to other websites not operated or controlled by Education Sports Community ("Third Party Websites"). Additionally, Education Sports Community may make its SwapSquad™ Offerings available through Third Party Websites. Education Sports Community is not responsible for the actions of any Third Party Website(s). This Privacy Policy does not apply to Third Party Websites and links to or from the SwapSquad™ Offerings do not imply that Education Sports Community endorses or has reviewed the Third Party Website(s). This Privacy Policy does not cover any collection or use of information that any Third Party Website(s) may collect from you, or the practices used by Third Party Websites to collect such information. If you decide to use, click on, access, or provide any personal information to any Third Party Website(s), you acknowledge that you are doing so at your own risk.

Terms and Conditions

Your use of the SwapSquad™ Offerings is subject to our Terms. This Privacy Policy incorporates all terms set forth in our Terms. The provisions contained in this Privacy Policy shall survive any termination of your account and/or use of the SwapSquad™ Offerings.

Changes to Privacy Policy

Education Sports Community reserves the right to make changes to this Privacy Policy from time to time. If a revision to this Privacy Policy is made, we will communicate any such change via the email address associated with your account. Such changes shall go into effect as of the "Last Updated" date provided above. Your continued use of the SwapSquad™ Offerings after any changes to this Privacy Policy shall indicate your agreement with the terms of such revised Privacy Policy; provided, however, that if the manner in which we use your personal information is materially expanded, you will have a choice as to whether or not we use your information in this expanded manner, and we will only use your information in this expanded manner where you affirmatively consent to such use.

Governing Law; Dispute Resolution

This Privacy Policy shall be construed and enforced in accordance with the laws of the State of New York, without regard to any conflict of law provisions.

Any dispute regarding the terms of this Privacy Policy shall be resolved in accordance with the terms of the "Arbitration Agreement and Procedures" set forth in the Terms.

Transfer of Personal Information Internationally

If you are visiting the Site and/or accessing the App from a country other than the country in which our servers are located, your communications with us may result in the transfer of personal information across international boundaries. By visiting the Site, accessing the App and/or otherwise communicating electronically with us, you consent to such transfers. Even if your jurisdiction does not have the same privacy laws as the jurisdiction where our servers are located, we will treat your information as subject to the protections described in this Privacy Policy.
